1. What Find Homemade is
Find Homemade ("we," "us") operates an online directory at findhomemade.com (the "Service") that lets independent home-based food makers ("Makers") — including cottage food producers and licensed home food businesses — publish listings, and lets the public ("Buyers") discover and contact them. We are a neutral venue and information platform — not a party to any transaction, not a food producer, retailer, delivery service, payment processor, or agent of any Maker or Buyer.
2. No food sales, no payments, no orders
All orders, payments, scheduling, fulfillment, refunds and disputes happen directly between the Buyer and the Maker, off-platform. We do not collect payment for food, hold funds, guarantee any order, or verify that any transaction occurs. Listing prices are Maker-supplied estimates, not offers by Find Homemade. Refunds, returns, cancellations and payment disputes are solely between the Buyer and the Maker and must be handled through the original payment method (e.g., a Stripe refund from the Maker’s own account, or the relevant app). Find Homemade does not issue refunds, does not mediate disputes, and is not liable for any order, payment, refund, or the quality or safety of any food.
Any third-party payment service a Maker chooses (e.g., Stripe, PayPal, Venmo, Cash App, Zelle) may charge the Maker its own processing fees. Those fees are set by, and paid to, that provider under the Maker’s own agreement with them — review your provider’s policy for current rates. Find Homemade charges no commission and takes no percentage of any sale; we never collect, hold, or receive money from a Maker’s food sales. Any fees are solely between the Maker and the payment provider.
Our optional "order request" and payment-link tools are a convenience only: they pass a Buyer's request and preferences to a Maker and may display the Maker's own third-party payment handle (e.g., PayPal, Venmo, Cash App, Zelle). We are not a party to, agent for, or guarantor of any resulting transaction, we never receive or hold the funds, and we are not responsible if an order is not fulfilled, is unsatisfactory, or if a payment is not honored or refunded. Any delivery or shipping fees are set and collected solely by the Maker. Cash payments (including "cash on pickup" and "cash on delivery") are arranged and handled in person, directly between the Buyer and the Maker — we never see, collect, or guarantee them. If a Maker connects their own payment processor (e.g., Stripe) to accept card payments, all funds are charged and settled directly to the Maker's own account; Find Homemade never receives, holds, or has access to those funds, takes no commission, and is not the merchant, processor, or a party to the transaction — the processor's own terms and fees apply between the Maker and that processor. Delivery-radius, ZIP, and shipping-area checks are estimates only (straight-line distance and general location data) provided to help Buyers and Makers — they are not a guarantee of service, coverage, or legality, and the Maker remains responsible for where and how they fulfill. Buyers and Makers are solely responsible for resolving any issue between themselves.
Any order, inquiry, or message records shown in a Maker's dashboard are provided as a convenience only. We do not guarantee that this history will be retained, complete, accurate, or available, and it may be lost, deleted, or altered at any time (including through routine cleanup, migration, error, or outage). Find Homemade is not responsible or liable for any lost or missing order history or records. Makers are responsible for keeping their own records — for taxes or any other purpose — and should export their data (e.g. via the CSV export) regularly.
3. Assumption of risk & food safety
Home-produced foods may be prepared in kitchens that are not licensed or routinely inspected by a government health authority, and may contain or contact allergens. Buyers assume all risk associated with obtaining and consuming such foods and are responsible for asking Makers about ingredients, allergens and preparation. We make no representation about the safety, quality, legality or fitness of any food or Maker.
4. Maker responsibilities & legal compliance
If you list as a Maker, you represent and warrant that you comply with all applicable federal, state and local food laws — including cottage food laws and/or any required food-establishment, home-processor or other permits — licensing, registration, sales caps, labeling and allergen-disclosure requirements; are solely responsible for the safety, accuracy, quality and legality of your products and listings; hold all required permits; and handle your own taxes and transactions. 5. Listings, content & license
You retain ownership of content you submit, but grant Find Homemade a worldwide, non-exclusive, royalty-free license to host, display, resize and promote it in connection with the Service. You warrant you have rights to all content you upload and that it is not misleading, infringing or unlawful. We may remove any listing or content, or suspend any account, at our discretion.
6. Prohibited conduct
You agree not to post false or misleading listings; scrape or harvest data; send spam or harassment; list alcohol, cannabis or other regulated/illegal items where prohibited; impersonate others; or interfere with the Service.
7. Paid features
Optional paid Maker subscriptions ("Verified") are for listing-enhancement features only and are never a commission on, or payment for, food sales. Verified may include a free trial period (e.g. the first month); if you do not cancel before the trial ends, your payment method is automatically charged the recurring fee and the subscription renews each billing period until you cancel. You can cancel any time from your dashboard to stop future billing. Fees already charged are non-refundable, including the first and any subsequent month once a billing period has begun, except where a refund is required by law. Cancelling stops future charges but does not refund the current period, and your Verified features remain active through the end of the period you paid for.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that listings are accurate, that Makers are licensed or compliant, or that the Service will be uninterrupted or error-free.
9. Limitation of liability & indemnity
To the maximum extent permitted by law, Find Homemade and its owners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any illness, injury, loss or damage arising out of food obtained through the Service or any Buyer–Maker dealing. Our total aggregate liability for any claim will not exceed the greater of the amount you paid us in the prior 12 months or US $100. You agree to indemnify and hold us harmless from claims arising out of your listings, products, conduct, or violation of these Terms or any law.
10. Dispute resolution & governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Disputes between Buyers and Makers must be resolved between those parties. Any dispute with Find Homemade will be resolved in the state or federal courts located in Florida.
